Sexual Offenses
In the State of Michigan, most prosecutor offices will take sexual crimes more serious than even the crime of homicide. The way these allegations are viewed has a vastly different effect based upon the location of the allegation. The way that Washtenaw, Wayne, Shiawassee, Eaton, Macomb, Lapeer, Oakland and Ingham County attempt to apply the law is extremely different.
What the criminal defense lawyer needs to understand is:
- What is the law?
- How is the law applied in this location?
- Is running a preliminary examination the right move or would waiving the preliminary examination be a beneficial strategy?
- Will the prosecutor allow the waiver of the prelim? (Each county has different policies on this issue. The view in Oakland County, as opposed to Macomb County, is as broad as the difference between night and day).
- What are the obstacles to a plea bargain or is this a case that should be pushed to trial from the onset?
